Course Content

The course will cover the Basics of Usul al-fiqh, legal maxims and higher objectives of Shariah. In particular we will be looking at the concepts of Betrothal (Khitbah), Marriage (Nikah), polygyny, Dissolution of Marriage (Talaq), Faskh (Judicial separation), Khula’ (divorce by mutual consent).

As far as possible the course will cover the views of the four madahibs.

There will also be discussion around whether Shariah law acceptable within the British legal system, and issues around Forced Marriage, Custody and Fatawas in Court. This aspect of the course will be covered by Rafia Irshad a Barrister who specialises in Family Law.

Course Leader

Sheikh Faizal Manjoo obtained his B A (Honours) in Islamic Studies, LLB, Diploma in Advanced Labour Law and Diploma in Advanced Banking Law from the University of Johannesburg . He also has an MA in Islamic Management, Finance and Banking from Loughborough University. He graduated as an Aalim Faadhil through the Darse Nizami system from Madrassah Arabia Islamia (South Africa).

Shaikh Manjoo is a practicing attorney at law and has a special interest towards family law, law of inheritance and Islamic Finance. He has invested his legal acumen in searching for ways in getting recognition of the Islamic Private Law and Muslim Personal Law within the secular legal system. He has been instrumental in developing new courses both at under-graduate and post-graduate levels.

Methodology
